  1. Deposit & Security Deposit:

A $750 deposit is required to guarantee dates, no interest will be paid on the security deposit. Once contract cancellation date has passed, the deposit will roll over to become a refundable Security Deposit to protect owners from any damages to the premises or other charges as agreed in sections 8-15 below. Damages and other charges listed will be deducted from the security deposit. Deposit due upon lease signing.

b.     Balance of Security Deposit, less any damages and excess utility bills, will be refunded if applicable, within 21 days of departure date and mailed to the address provided on this agreement or refunded via Credit Card if requested

c.     All house keys must be received by owners to receive Security Deposit refund.

d.     NSF checks/Denied credit card transactions – If a check is returned NSF or if a Credit Card Charge is later reversed for denial, occupant shall pay $35.00 as an NSF fee.  Occupant agrees that this charge represents a fair and reasonable estimate of the costs owner may incur by reason of occupant’s NSF Payment.  An NSF check will result in cancellation of the agreement if the required payment is not made by the applicable payment due date.

  

  1. Spa/Swimming Rules:

Underage children and children without adult supervision should not use spa or swimming pool at any time. Remember there are certain health risks associated with spa use.  Use at your own risk.

Spa heating is complimentary based on normal usage (up to a few hours per day).  Spa heater should not be used continually.  If it is determined the Spa was used excessively as determined by pool temperature the prevailing pool heating fee may be deducted from the Security Deposit.


Pool Heating:

Swimming Pool heating is $50.00/day which is an actual cost to owners.  The pool will be heated to 85F degrees which is an ideal swimming temperature.  Pool heating for the above rental period is $150.00. If heating is elected, the amount should be included with the rental payment. Pool heating must be elected no less than 5 days in advance of check-in and must be paid for in advance. Pool heating is not generally required during summer months.

c.     _____I understand that if it is determined pool was heated without owner’s authorization and payment or temperature dials are adjusted in any way to increase temperature, heating costs will be deducted from security deposit.

d.     _____I understand glass is not allowed by or in the swimming pool/Jacuzzi at any time. If broken glass is found in the swimming pool/Jacuzzi and determined to be from your rental, entire Security Deposit will be forfeited to drain, clean and refill pool. Plastic cups are provided for outdoor use.

 

  1. Cancellation Penalty:

The Deposit to hold reservation dates is refundable (minus a $100 reservation fee) up to 90 days prior to rental start date.  After 90 day date, all payments are forfeited in full if reservation is cancelled.  We strongly urge our renter’ss to purchase Trip Insurance. Storms or Inclement Weather: No refunds will be provided for storms, inclement weather, widespread power outages or “acts of god” unless local authorities enforce a mandatory evacuation. In this case, all unused rents following the mandatory evacuation date will be refunded.

 

  1. Utilities:

All utilities, except pool heating indicated in section 8, will be paid by owners. Monthly rentals may require a separate utility agreement.

 

  1. Check-In/Check Out Times:

Check-In time is no earlier than 3:00 pm on the day of your scheduled arrival.  If you arrive at the property earlier than check-in time without prior arrangements, you will be charged an early check-in fee of $50.00.

Check-Out time is no later than 12:00 pm on the day your scheduled departure.  If you do not vacate the premises on time without prior arrangements, you will be charged a late check-out fee or one additional night’s stay.

 

Early Check-In (10:00 am) and/or Late Check-Out (5:00 pm) may be available depending on home’s rental status. If early Check-In and/or Late Check-Out are requested, notify owners in advance. If available, a $50 early check-in fee and/or $50 late check-out fee will be charged. Early Check-In and Late Check-Out are not guaranteed.  Owners will reimburse renter’s any fees paid if we cannot accommodate the Early Check-In/Late Check-Out.

**Owners reserve the right to cancel early check-in/late check-out, if elected, prior to arrival if it interferes with another booking.  In the event this situation occurs, the early check-in/late check-out fee will be refunded to renters.

 

Checkout Procedure:  See Addendum 1 attached to this rental contract for check-out requirements.  Failure to perform the check-out procedure as listed in Addendum 1 may result in deductions from or forfeiture of Security Deposit. Failure to return all keys will result in a re-keying fee of $75.00, which will be deducted from the security deposit.

We are not responsible for any personal items left behind, lost or stolen.

 

  1. Pets:

a.     Pets are NOT allowed on the property at any time

  1. Smoking: THIS IS A NON-SMOKING HOME

a.     Smoking is NOT allowed on the property except for outdoor non-roofed areas.

                                                    i.     _______ I will NOT smoke inside the premises or outdoors under roofed areas, I understand that if I do smoke in these areas I will forfeit my entire security deposit. Butts are to be disposed of properly and not left anywhere on the property.

 

  1. Unauthorized Parties/Guests/On-site Events:

a.     Parties/Unauthorized guests/Events are not allowed on the premises without prior written consent of the owners. Failure to comply with this rule will result in forfeiture of entire security deposit and immediate eviction from the property.

  1. City of Palm Springs Noise Ordinance Acknowledgment:

______ I acknowledge that as the signer of this contract I am the responsible party for enforcing the strict noise ordinances imposed by The City of Palm Springs on vacation rentals.  A representative of Palm Springs Cool Rentals must contact you within 45 minutes of a noise complaint.  Failure to comply with the noise complaint may result in fines and penalties to “renter’ss” by the City of Palm Springs as well as a potential forfeiture of a portion or all of the security deposit.

 

  1. Condition of Premises:

______ I acknowledge occupant has not viewed the premises prior to entering into this agreement. Occupant shall, on arrival, examine the premise, all furniture, furnishings, appliances, fixtures and landscaping, if any, and shall immediately report, in writing, if any are not in operating condition or are in disrepair.  Reporting repairs does not give occupant the right to cancel this agreement or receive a refund of any payments made unless repairs needed prevent the occupants use and enjoyment of premises.

 

  1. Entry:

______ I acknowledge owner and owners’ representatives and agents have the right to enter the premises, at any time, (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed upon services; (ii) to verify the occupant has complied with the terms of this agreement; (iii) in case of emergency.

 

  1. Assignment Clause:

______ I acknowledge that this agreement is between owner and signed occupant.  The agreement is not assignable to any other person without approval from owners.  I acknowledge that owners will not honor an assigned agreement without prior approval. The occupant may in no way sublet this property or allow guests who are not listed in the contract.

 

  1. Unavailability:

______ I acknowledge that if for any reason beyond the control of owner or owner’s representative, the premises is unavailable, owner may substitute a comparable unit or cancel the agreement and refund in full to occupant all payments made.

    

  1. Liability Waiver:

_____ (initial) OWNERS SHALL NOT BE LIABLE TO RENTER, RENTER’S GUESTS, LICENSEES OR INVITEES OR ANY OTHER PERSON FOR ANY INJURY, LOSS OR DAMAGE TO ANY PERSON OR PROPERTY, INCLUDING THEFT, ON OR ABOUT THE PREMISES. RENTER SHALL HOLD OWNER AND MANAGERS HARMLESS AND INDEMNIFIED FROM AND AGAINST ALL LOSS, INJURY OR DAMAGE OCCASIONED BY THE USE OR MISUSE OR ABUSE OF ANY PART OF THE PREMISES INCLUDING THE APPROX. 6’ DEEP SWIMMING POOL AND SPA. KEEP CHILDREN AWAY FROM SPA AND POOL UNLESS THERE IS CONSTANT ADULT SUPERVISION. RENTER AGREES NOT TO HOLD OWNER’SS LIABLE OR RESPONSIBLE FOR ANY INJURIES, ACCIDENTS OR ANY OTHER DAMAGES AS RESULT OF POOL USE AND FROM OR AGAINST ANY OMISSION, NEGLECT, OR DEFAULT OF RENTER, RENTER’S GUESTS, LICENSESS OR INVITEES.

 

  1. Acceptance of Rental Agreement:

FROM MY SIGNATURE BELOW, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE RULES AND REGULATIONS. I CERTIFY THAT I AM AT LEAST 25 YEARS OF AGE AND THAT I WILL BE HELD RESPONSIBLE FOR THE CARE OF THIS PROPERTY BEING RENTED UNDER MY NAME.  I ACCEPT FULL RESPONSIBILITY FOR DAMAGES OR EXTRA CLEANING CHARGES, SHOULD THEY BE DISCOVERED DURING OR AFTER DEPARTURE.

Addendum 1

Check out Procedure

 

WE HOPE YOU HAVE ENJOYED YOUR STAY

 

In an effort to keep the cleaning fee to a minimum, we require our guests to perform the following actions prior to check-out. Failure to do any of the following will result in a deduction from your security deposit.

 

·      Throw away all perishables from the refrigerator

 

·      Dispose of all food items in OUTSIDE trash can

 

·      Turn Off:  Pool Heater/Jacuzzi if required

 

·      Leave All Dishes Clean

 

·      Place all outdoor cushions and pool toys back in cushion box where you found them.

 

·      Cover outdoor grill

 

·      Return all magazines, books and furniture to where you found them

 

·      Turn OFF: Stereo, Television, DVD Player, Lights and Appliances

 

·      Turn thermostat A/C/Heat to OFF position

 

·      Turn off all Lights and Appliances

 

·      Lock All Doors and Windows
